AES Enforced Compliance
Enforcement begins February 1, 2009
in September 2008, it was communicated that US Customs and Border protection, along with the Bureau of Census, had ruled that the long awaited AES regulations that result in "No Docs, No load of cargo" was scheduled with an effective date of October 1, 2008. The implementation came with a grace period whereby fines or penalties would not be livied until CBP published it's penalty Mitigation Guidelines.
That grace period is over and with an effective date of February 1, 2009, fines and penalties will be levied for cargo that is non AES compliant as per CBP decision 08-50. We will do everything within our control to not load cargo that is not AES compliant, However, any fines or penalties and related charges (demurrage, reschedule fees, late AES fees, etc.) received by us as a result of late and/or incorrect documentaiton will be passed on to the respective filing/responsible party.
